Terms of Service
COREJEWELS (hereinafter referred to as "the Company") hereby establishes the terms and conditions of use (hereinafter referred to as "the Terms") for its operated website (hereinafter referred to as "the Service") as follows. By using the Service, users are deemed to have agreed to the following conditions.
Chapter 1 General Provisions
Article 1 Scope and Amendments of these Terms
1. These Terms shall apply to the Company and users of the Service, including members (as defined in Article 3) (hereinafter referred to as "Users"), regarding the use of the Service. 2. The Company may amend these Terms without prior consent from Users by notifying Users through methods deemed appropriate by the Company.
Article 2 Use of the Service
1. Users shall use the Service in accordance with these Terms and other rules separately stipulated by the Company. 2. The Company may change the content of the Service without prior consent from Users.
Chapter 2 Members
Article 3 Members
"Members" refers to individuals who have approved these Terms, applied for membership registration in accordance with the procedures prescribed by the Company, and whose application has been approved by the Company.
Article 4 Membership Registration
1. Individuals wishing to join shall apply for membership registration from the membership registration page of the Service in accordance with the method specified by the Company. 2. The Company shall approve the application referred to in the preceding paragraph by sending a registration confirmation email to the applicant. 3. The Company may not approve the registration application if any of the following items apply: (1) If it is found that the applicant has previously violated these Terms and has been subject to disciplinary action, such as membership cancellation. (2) If the applicant's application contains false information. (3) In any other case where the Company deems the approval of the registration application inappropriate. 4. Membership registration shall be limited to individuals residing in Japan. 5. The user agreement between the Company and the member based on these Terms shall remain valid between the Company and the member from the date of registration completion until the date of cancellation of the member's registration. 6. Please note that individuals registering as members are deemed to guarantee to the Company that they are 20 years of age or older, or if they are under 20 years of age, they have obtained parental consent for sales contracts.
Article 5 Notification of Changes
If there is any change in the member's address, name, telephone number, credit card number, or any other information registered with the Company, the member shall promptly notify the Company in accordance with the method separately instructed by the Company.
Article 6 Suspension of Service Use, Cancellation of Membership Registration
The Company may suspend the use of the Service or cancel membership registration without prior notice to the member if the member falls under any of the following: (1) If it is found that the member has previously violated these Terms and has been subject to disciplinary action, such as membership cancellation. (2) If there is a delay in payment obligations for fees related to the Service or other defaults. (3) If the member commits an act prohibited under Article 10 (Prohibited Acts). (4) In any other case of violation of these Terms.
Article 7 Management of ID and Password
1. Members shall be responsible for managing the email address and password they have set. 2. Members shall not transfer, lend, or disclose their user ID and password to third parties. 3. Members shall be responsible for any damages caused by insufficient management of user ID and password, errors in use, or use by third parties. 4. If a member discovers that their user ID and password are being used fraudulently by a third party, they shall immediately notify the Company. 5. Users shall acknowledge the risk of leakage accompanying payment methods such as transmitting credit card numbers when using the Service, and shall do so under their own responsibility. Article 10 Prohibited Acts
Users shall not engage in any of the following acts: (1) Submitting false registration information when using the Service. (2) Acts that obstruct the operation of the Service or may hinder the Service. (3) Using the Service with unauthorized use of credit cards. (4) Unauthorized use of user IDs and passwords. (5) Acts that cause inconvenience, disadvantage, or damage to other users, third parties, or the Company, or acts that may cause such inconvenience, disadvantage, or damage. (6) Acts that infringe on the copyrights, privacy, or other rights of other users, third parties, or the Company, or acts that may infringe on such rights. (7) Acts that violate public order and morals or other laws and regulations, or acts that may violate such laws and regulations. (8) Using the Service for commercial purposes. (9) Sending unsolicited advertisements, promotions, solicitations, or similar emails to other members, or sending emails that may constitute such acts, obstructing the receipt of emails by other members, or requesting or complying with requests for chain mail forwarding. Article 11 Copyright
1. Users may not use any information provided through the Service beyond the scope of personal private reproduction and other restrictions on copyright recognized by the Copyright Act without the permission of the right holder. 2. In the event that a problem arises due to a violation of the provisions of this Article, the User shall resolve such problem at their own responsibility and expense, and shall not cause any inconvenience or damage to the Company.
Chapter 4 Purchase of Products
Article 12 Purchase of Products
1. Users may purchase products or services (hereinafter referred to as "Products, etc.") from the Company using the Service. 2. If a User wishes to purchase Products, etc., they shall apply for the purchase of products or use of services in accordance with the method specified by the Company. 3. A sales contract for the Products, etc. shall be concluded between the User and the Company at the time the Company sends an email accepting the application referred to in the preceding paragraph to the User. 4. Delivery of Products, etc. through the Service shall be limited to within Japan.
Article 13 Cancellation of Contract
1. The Company may cancel the contract if any of the following items apply: (1) If the user violates these Terms. (2) If the credit card company designated by the user notifies of credit failure. (3) If circumstances are found that indicate the user's payment ability has become precarious. (4) If the product is out of stock and cannot be delivered easily. (5) If the product cannot be delivered due to unknown address or prolonged absence. 2. Notwithstanding the provisions of the preceding paragraph, if there is any fraudulent or inappropriate act regarding the use of this service, the Company may cancel or terminate the sales contract or take other appropriate measures.
Article 14 Payment Method
1. The total payment amount for products, etc., will be the product purchase price including consumption tax, shipping fee, and transfer fee. 2. Payments for products, etc. purchased through this service shall be made by credit card in the user's name, or by other payment methods separately approved by the Company. 3. In the case of payment by credit card, the user shall comply with the conditions separately agreed upon between the user and the card company. In the event of a dispute between the user and the credit card company, etc., the parties concerned shall resolve it, and the Company shall bear no responsibility whatsoever.
Article 15 Returns of Products, etc.
1. Returns of products are not allowed, except in cases of damage during delivery, product defects, incorrect products, or cases separately approved by the Company. Furthermore, returns of such products and exchanges of products with defects, or cancellations if exchanges are not possible, shall only be possible if the user contacts the Company for a return within the period stipulated by the Company (within 7 days) after receiving the product. 2. The user shall return the product referred to in the preceding paragraph at the user's expense in accordance with the method separately determined by the Company.
Chapter 5 Operation of the Service
Article 16 Information Management
If the Company deems that comments and other information transmitted by users with their consent for use are usable, the Company may use them in the Service without prior notice to the users, and may delete them without prior notice to the users if any of the following items apply: (1) If the information is clearly found to infringe on the copyrights or other rights of the Company or a third party, or to clearly damage the honor or credibility of the Company or a third party. (2) If the Company receives a warning from a third party that the information infringes on the copyrights or other rights of the third party, or damages the honor or credibility of the third party. (3) If the information is clearly found to violate the laws of Japan or applicable foreign laws. (4) If ordered to delete by a government agency.
Article 17 Maintenance of the Service
The Company may, without prior notice to users, suspend all or part of the provision of the Service in the following cases in order to maintain the Service in good operating condition: (1) In cases of regular or emergency maintenance of the system. (2) In cases where system operation becomes difficult due to fire, power outage, obstruction by a third party, etc. (3) In any other case where the Company deems it unavoidable to stop the system.
Article 18 Other Disclaimers
1. If the Company has an obligation to notify the User, it shall be deemed to have fulfilled that obligation by sending a notification to the email address previously registered by the User, and regarding product delivery, by shipping the product to the delivery address specified by the User at the time of purchase. 2. Regardless of the legal cause of action, the Company shall not be liable for any damages, losses, or disadvantages related to the use of the Service and products sold through the Service, except as stipulated in the preceding article. 3. The Company shall not be liable for any damages incurred by the User due to the inability to use the Service. 4. The Company shall be exempted from liability by processing administrative matters in accordance with the User's registration details. 5. Regardless of the legal cause of action, the Company shall not be liable for any damages, losses, or disadvantages incurred in connection with the use of the Service. 6. If a User causes damage to another User or a third party by using the Service, the User shall resolve such issue at their own responsibility and expense, and shall not cause any inconvenience to the Company. 7. The Company shall be exempted from liability by verifying the identity of the User through a method designated by the Company when changing the User's password, etc. 8. The User shall bear the costs related to the installation of computer equipment and communication equipment necessary for using the Service, as well as telephone charges, LAN usage fees, and application fees incurred for using the Service. 9. Users shall use Internet Explorer 4.X or higher or Netscape Communicator 4.X or higher as the browser for using the Service. If any problems arise, such as the screen not displaying correctly, due to the use of a browser other than that designated by the Company, the Company shall bear no responsibility whatsoever and shall not accept any inquiries.
Article 19 Miscellaneous
1. Communication between the Company and the user shall, in principle, be conducted via email. 2. In the event that a problem arises regarding the use of this service that cannot be resolved by these terms of use or the Company's guidance, the Company and the user shall discuss the matter in good faith and resolve it. 3. If litigation becomes necessary regarding the use of this service, the Tokyo District Court shall be the exclusive court of first instance. 4. In the event that the user incurs liability for damages due to non-payment of the purchase price or other acts violating these terms, and the Company uses an attorney to claim and collect such damages, the attorney's fees based on the attorney fee regulations shall also be borne by the user.
Supplementary Provisions
These terms shall apply to all members from June 13, 2011.
